Letter Sent to Putnam County Voters Accuses Candidate for Sheriff to Be ‘Racist and Discriminatory’
There is a mailer being distributed to voters in Putnam County, NY in regards to the upcoming Sheriff's election. The mail includes some Earth shattering claims about Kevin McConville, one of the candidates for Putnam County Sheriff. It appears to be court documents that detail allegations of racism made against McConville and it reads:
Deborah A. Batts, District Judge
Plaintiff Bryan Henry ("Plaintiff" or "Henry"), an African-American male, together with eight African-American plaintiffs and one Hispanic plaintiff all of whom are current or former employees of the Metropolitan Transportation Authority ("MTA") Police Department ("MTA PD") commence this action against the MTA and four MTA Executive Officers (collectively "defendants") alleging violations of Title VII of the Civil Rights Act of 1964, 42 U.S.C. & 2000e at seq, the New York State Human Rights Law ("NYSHRL"), the New York City Human Rights Law ("NYCHRL"), and 42 U.S.C. SS 1981 and 1983. Plaintiff maintains that Defendants discriminated against him on the basis of his race by denying him promotions. subjecting him to a hostile work environment, and engaging in a pattern or practice of discrimination, and retaliated against him for complaining to his superiors, The New York State Division of Human Rights ("NYSDHR"), and the Police Benevolent Association ("PBA") about alleged discrimination. Defendants now move pursuant to Fed. R. Civ. P. 56 for summary judgement on each of the Plaintiff's claims.
For the reasons set forth herein, Defendants Motion for Summary judgement is granted, in part, denied in part and the Court reserves the decision in part."
The page is broken up by a message that stretches across the page and reads:
"Please Don't Vote for Kevin McConville!
He is Racist and Discriminatory
How would you feel if this was your mother, wife or daughter that he was referring to?
Please read paragraph "B" for proof."
That message also comes complete with an arrow directing you to read paragraph B that says:
"B. Plaintiff's Employment with MNR PD
Henry alleges he was discriminated against and subjected to racially derogatory remarks from early on in his career. For example, Defendant McConville, then a Detective, allegedly stated, in front of Henry and a group of Caucasian officers, that he was going to go to Henry's house and f--- Henry's wife, who was Caucasian (Pl, s 56.1 Stmt. B.) On another occasion, when Plaintiff requested back-up support, his supervisor allegedly denied the request and accused him of being afraid of guns and white people. (id. C.) Throughout his time as a police officer, Plaintiff alleges he was isolated and ignored. (1d C-D.) "
The document continues and outlines more allegations of racism by Kevin McConville. McConville is opposed by incumbent Democrat Robert Langley. Kevin McConville's campaign website does not address the claims made against him but describes him in this way:
"Kevin McConville, a lifelong resident of Putnam County, has over thirty years of law enforcement experience, having worked for the Metropolitan Transportation Authority (MTA) Police Department, culminating with the rank of Chief of the Department."
This is the document below (WARNING: Vulgar language)
I don't know Kevin McConville, Robert Langley, the Plaintiff named Henry or the circumstances surrounding any of these claims, all I know is this is being sent to people's homes in Putnam County.
If someone is sending around a mailer that says a person is racist or discriminatory, that person should be allowed to answer to it and I'm offering that. Both Kevin McConville and the person responsible for the distribution of the letter are invited to be guests on the Ethan and Lou Show, or to answer me in print.
