Idling Car Leads to Felony DWI Arrest in Dover
New York State Police from the Dover barracks responded to a report of a suspicious vehicle in the area of 9 Market Street in Dover at 4 AM on Sunday, and it led to felony charges for the driver, Saturnino Lopez, a 47-year-old Dover resident.
Troopers responded to the report and they found the car idling with Lopez passed out in the driver's seat. When they were finally able to awaken Lopez, he immediately attempted to drive away. Troopers got the vehicle stopped and removed the driver at which time police discovered several empty beer cans in the car. Lopez appeared physically impaired to the police.
Troopers administered the Field Sobriety Tests which Lopez failed. A breathalyzer determined that Lopez had a BAC of.20 percent.
While arresting the driver, Troopers learned that Lopez had previously been convicted of aggravated DWI and had his license revoked due to that conviction. Lopez was arraigned in Dover Justice Court on charges of Felony Aggravated DWI, Felony Aggravated Unlicensed Operation, Operating a Motor Vehicle Without an Ignition Interlock Device.
He was remanded to the Dutchess County Jail on a $5,000 cash bail or $10,000 bond. The defendant is due back in Dover Justice Court on December 21st.
